The following information gives you a simple overview of what happens to your personal data when you visit this website. Personal data is all data through which you can be personally identified. For detailed information about data protection, please refer to our privacy statement listed below this text.

Data collection on this website

Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find their contact details in the “Information about the data controller” section in this privacy statement.

How do we record your data?

On the one hand, your data is collected as a result of you providing it to us. This can be data you enter in a contact form, for example.

Other data is collected automatically, or with your consent, by our IT systems when you visit the website. This is primarily technical data (e.g. internet browser, operating system or time of page view). This data is collected automatically as soon as you enter this website.

What do we use your data for?

Part of the data is collected to ensure error-free provision of the website. Other data may be used to analyse your user behaviour.

What rights do you have in relation to your data?

You have the right, at any time, to receive information about the origin, recipients and purpose of your stored personal data free of charge. You also have a right to request the correction or erasure of this data. Insofar as you have given your consent to data processing, you can revoke such consent at any time with future effect. You also have the right to request the restriction of the processing of your personal data in certain circumstances. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

With regard to this matter as well as other questions related to the topic of data protection, you can contact us at any time.

Analysis tools and tools of third-party providers

When visiting this website, your surfing behaviour may be subject to statistical analysis. This is done mainly with ‘analysis programmes’.

Detailed information about these analysis programmes can be found in the privacy statement below.

2. Hosting and content delivery networks (CDN)

This website is hosted by an external service provider (host). The personal data collected on this website is stored on the host’s servers. Such data may primarily be IP addresses, contact requests, meta and communication data, contractual data, contact details, names, website accesses and other data generated via a website.

The host is used for contract performance purposes vis-à-vis our potential and existing customers (GDPR Art. 6 (1)(b)) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (GDPR Art. 6 (1)(f)).

Our host will only process your data to the extent that such processing is necessary for the fulfilment of its service obligations and will follow our instructions with regard to said data.

We use the following host:

3. General information and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and handle it in accordance with the statutory data protection regulations as well as this privacy statement.

When you use this website, various personal data is collected. Personal data is data through which you can be personally identified. This privacy statement explains which data we collect and what we use such data for. It also explains how and for what purpose this is done.

We would like to point out that the transfer of data on the Internet (e.g. communication by e-mail) may have security gaps. It is not possible to completely protect the data from third-party access.

Information about the data controller

The data controller for data processing on this website is:

Holger Weidmann
Krautzberger GmbH
Stockbornstrasse 13
65343 Eltville

Telephone: +49 6123/698-0
E-mail: mail@krautzberger.com

The data controller is the natural or legal person who alone, or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).

Storage period

Unless a more specific storage period is stated within this privacy statement, your personal data will be retained by us until the purpose for processing the data no longer applies. Insofar as you make a justified request for erasure or revoke consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once such reasons no longer apply.

Note regarding data transfer to the USA and other third countries

Tools from companies based in the USA or other non-secure third countries from a data privacy law standpoint are integrated on our website. When these tools are active, your personal data may be transferred to and processed in said third countries. We would like to point out that it is not possible to ensure a level of data protection comparable to that which exists in the EU for these countries. For example, US companies are obligated to surrender personal data to security authorities without you, as the data subject, being able to take legal action against such a surrender. It cannot therefore be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for surveillance purposes. We are not able to exert any influence on these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. Insofar as you have already granted your consent, you can revoke it at any time. The legality of the data processing carried out until revocation remains unaffected by the revocation.

Right to object to the collection of data in specific cases and to direct marketing (GDPR Art. 21)
IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. ART. 6 (1) (E) OR (F), YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA, AT ANY TIME, FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY STATEMENT. INSOFAR AS YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR SUCH PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR SUCH PROCESSING IS FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION AS PER GDPR ART. 21 (a)).

INSOFAR AS YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT, AT ANY TIME, TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS CONNECTED WITH SAID DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION AS PER GRPD ART. 21 (2)).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects have a right to lodge a complaint with a supervisory authority, specifically in the member state of their ordinary residence, place of work or the place of the alleged breach. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent, or in performance of a contract, surrendered to you or to a third party in a common, machine-readable format. Insofar as you request the direct transfer of the data to another data controller, such a transfer will only be carried out if it is technically feasible.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the padlock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transfer to us cannot be read by third parties.

Information, erasure and rectification

Within the framework of the applicable statutory provisions, you have the right – at any time – to free information about your stored personal data, its origin and recipient and the purpose of the data processing and, if applicable, a right to rectification or erasure of said data. With regard to this matter as well as other questions related to the topic of personal data, you can contact us at any time.

Right to restrict processing

You have the right to request the restriction of data processing in relation to your personal data. You can contact us at any time in this regard. The right to restrict processing exists in the following cases:

Insofar as you dispute the accuracy of your personal data held by us, we will usually need time to verify such a dispute. While we verify your dispute, you have the right to request the restriction of data processing in relation to your personal data.
Insofar as the processing of your personal data was carried out/is being carried out unlawfully, you can request the restriction of data processing instead of erasure.

If we no longer require your personal data, but you require it in order to exercise, defend or enforce legal claims, you have the right to request the restriction of data processing in relation to your personal data instead of erasure.

Insofar as you have objected as per GDPR Art. 21 (1), there must be a balancing of your interests and our interests. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of data processing in relation to your personal data.

Insofar as you have restricted the processing of your personal data, such data may – apart from being stored – only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest on the part of the European Union or a member state thereof.

Objection to marketing e-mails

The use of contact details published as part of the imprint obligation for the transmission of marketing and information material not expressly requested is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of promotional material, for example by means of spam e-mails.

Our Internet pages use “cookies”. Cookies are small text files and do not cause any damage to your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. The website operator has a legitimate interest in storing cookies to ensure the technically flawless and optimised provision of its services. Insofar as consent to the storage of cookies has been requested, the storage of the cookies in question is based exclusively on such consent (GDPR Art. 6 (1)(a)); this consent can be revoked at any time.

You can set your browser in such a way that you will be informed about cookies being set and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. The deactivation of the cookies may limit the functionality of this website.

Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you about such use separately within the framework of this privacy statement and, if necessary, request your consent.

The data collected will be stored until you request that we delete it or until you delete the Borlabs Cookie yourself, or until the purpose for storing said data no longer applies. Mandatory statutory retention periods remain unaffected. Details of data processing in relation to the Borlabs Cookie can be found at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.

The use of Borlabs Cookie consent technology is done in order to obtain the legally required consent for the use of cookies. The legal basis for this is GDPR Art. 6 (1)(1)(c).

This data is not merged with other data sources.

This data is collected on the basis of GDPR Art. 6 (1)(f). The website operator has a legitimate interest in the technically flawless presentation and optimisation of its website –- to this end, the server log files must be collected.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you have provided there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up enquiries. We will not share this data without your consent.

The data is processed on the basis of GDPR Art. 6 (1)(b), insofar as your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (GDPR Art. 6 (1)(f)) or on your consent (GDPR Art. 6 (1)(a)) insofar as this has been requested.

The data you enter in the contact form will be retained by us until you request us to delete it, revoke your consent for its storage, or the purpose for storing the data no longer applies (e.g. after we have finished processing your enquiry). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Enquiries via e-mail, telephone or fax

Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. Analysis tools and advertising

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. The Google Tag Manager itself does not create any user profiles, does not store cookies, and does not perform any independent analysis. It is used solely for the administration and playout of the tools integrated via it. However, Google Tag Manager collects your IP address, which may also be transferred to Google’s parent company in the United States.

Google Tag Manager is used on the basis of GDPR Art. 6 (1)(f). The website operator has a legitimate interest in enabling quick and uncomplicated integration and administration of various tools on its website. Insofar as appropriate consent has been requested, processing is carried out exclusively on the basis of GDPR Art. 6 (1)(a); this consent can be revoked at any time.

Google Analytics

This website uses functions of the Google Analytics web analysis service. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, length of visit, operating systems used and the origin of the user. This data may be conflated by Google in a profile that is assigned to the respective user or their device.

Google Analytics makes use of technologies that enable user recognition for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google regarding the use of this website is usually transferred to a Google server in the USA and stored there.

This analysis tool is used on the basis of GDPR Art. 6 (1)(f). The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising. Insofar as appropriate consent has been requested (e.g. consent to the storage of cookies), processing is carried out exclusively on the basis of GDPR Art. 6 (1)(a); this consent can be revoked at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

IP anonymisation

We have activated the IP anonymisation function on this website. This means that your IP address will be truncated by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area before being transferred to the USA. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and be truncated there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity, and providing other services relating to website activity and Internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin, which is available via the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

Further information on how Google Analytics handles user data can be found in Google’s privacy statement: https://support.google.com/analytics/answer/6004245?hl=de.

Data processing

We have concluded a data processing agreement with Google and fully implement the stringent requirements of the German data protection authorities when using Google Analytics.

Storage period

Data stored by Google at a user and event level, which is linked to cookies, user identifiers (e.g. User ID) or advertising IDs (e.g. DoubleClick cookies, Android advertising ID), will be anonymised or deleted after 14 months. Details in this regard are available via the following link: https://support.google.com/analytics/answer/7667196?hl=de

6. Newsletter

MailChimp with deactivated performance measurement

This website uses the services of MailChimp in order to send newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

MailChimp is a service that can be used to organise the sending of newsletters, for example. Insofar as you enter data for the purpose of receiving the newsletter (e.g. e-mail address), such data will be stored on MailChimp’s servers in the USA. We have deactivated the performance measurement with MailChimp, which means that MailChimp will not evaluate your behaviour when you open our newsletters.

If you do not wish for your data to be transferred to MailChimp, you must unsubscribe from the newsletter. We provide a corresponding link for this in every newsletter communication.

The data is processed on the basis of your consent (GDPR Art. 6 (1)(a)). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing that has already been carried out remains unaffected by the revocation.

The data you provide for the purpose of receiving the newsletter will be stored by us, or by the newsletter service provider, until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list once you have unsubscribed from the newsletter. Data, which we have stored for other purposes, remains unaffected by this.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://mailchimp.com/eu-us-data-transfer-statement/ and https://mailchimp.com/legal/data-processing-addendum/#Annex_C_-_Standard_Contractual_Clauses.

Once you have unsubscribed from the newsletter distribution list, your e-mail address will be stored by us, or by the newsletter service provider, in a blacklist if necessary, in order to prevent future mailings. The data from the blacklist is only used for this purpose and is not merged with other data. This is in both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of GDPR Art. 6 (1)(f)). There is no time limit for how long data is stored in the blacklist. You can object to such storage insofar as your interests outweigh our legitimate interest.

Further information about MailChimp’s data protection provisions can be found here: https://mailchimp.com/legal/terms/.

Conclusion of a data processing agreement

We have concluded a data processing agreement with MailChimp. Under this agreement, MailChimp is obligated to protect the data of our customers and not share said data with third parties.

7. Plugins and tools

YouTube with enhanced data protection

This website embeds videos from YouTube. The operator of these pages is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in privacy-enhanced mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the sharing of data with YouTube partners is not necessarily excluded by privacy-enhanced mode. Consequently, YouTube – regardless of whether you watch a video – establishes a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to YouTube’s servers is established. This lets the YouTube server know which of our pages you visited. If you are logged into your YouTube account, you make it possible for YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, after starting a video, YouTube may store various cookies on your device or use comparable recognition technologies (e.g. device fingerprinting). This allows YouTube to obtain information about visitors to this website. This information is used, for example, to collect video statistics, improve the user experience, and prevent attempted fraud.

If applicable, further data processing operations may be triggered after starting a YouTube video. We have no control over such operations.

YouTube is used in the interest of ensuring an appealing presentation of our online offers. This is a legitimate interest within the meaning of GDPR Art. 6 (1)(f). Insofar as appropriate consent has been requested, processing is carried out exclusively on the basis of GDPR Art. 6 (1)(a); this consent can be revoked at any time.

Further information about privacy at YouTube can be found in their privacy policy: https://policies.google.com/privacy?hl=de.

Google Web Fonts (local hosting)

This site uses web fonts provided by Google to ensure the uniform display of fonts. Google Fonts are installed locally. In this context, no connection to Google servers is established.

Further information about Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy statement: https://policies.google.com/privacy?hl=de.

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter referred to as “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

reCAPTCHA is used to establish whether data input on this website (e.g. in a contact form) is made by a human or by an automated programme. To this end, reCAPTCHA analyses the behaviour of the website visitor on the basis of various characteristics. This analysis begins automatically as soon as the visitor enters the website. For analysis purposes, reCAPTCHA evaluates various information (e.g. IP address, time spent by the visitor on the website or mouse movements made by the user). The data collected during analysis is shared with Google.

reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place.

This data is stored and analysed on the basis of GDPR Art. 6 (1)(f). The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and from SPAM. Insofar as appropriate consent has been requested, processing is carried out exclusively on the basis of GDPR Art. 6 (1)(a); this consent can be revoked at any time.

Further information about Google reCAPTCHA, can be found in the Google Privacy Policy and the Google Terms of Service via the following links: https://policies.google.com/privacy?hl=de and https://policies.google.com/terms?hl=de.
